Terms and Conditions

Definitions

  • Entrepreneur: GlobalFindr, established in 2023 under Chamber of Commerce no. 58149406.
  • GlobalFindr: The app where you can find and share Church events worldwide.
  • Event promotion: A free photo and video sharing app available on iPhone and Android
  • Subscription user: the person with whom GlobalFindr has entered into an (electronic) agreement.
  • Parties: GlobalFindr and Subscription user together.
  • Consumer: a user who is also an individual and who acts as a private person.

Article 1 – Applicability of general terms and conditions

  • These terms and conditions apply to all quotations, offers, activities, orders, agreements and deliveries of services by or on behalf of GlobalFindr.
  • The parties can only deviate from these terms and conditions if they have expressly agreed to this in writing through Email.
  • The parties expressly exclude the applicability of additional and/or deviating general terms and conditions of the user or of third parties.

Article 2 – Prices

  • All prices used by GlobalFindr are in euros (€), include VAT and exclude any other costs such as administration costs and levies unless expressly stated otherwise or agreed otherwise.
  • All prices that GlobalFindr uses for its services, on the app or otherwise made known, GlobalFindr can change at any time.
  • The parties agree on a monthly or yearly subscription amount as the price for the service(s) provided by GlobalFindr, unless the parties have explicitly agreed in writing on any other fixed price, which cannot be deviated from.
  • All prices that GlobalFindr has made public on the app are binding, upon payment for a monthly/yearly subscription.
  • GlobalFindr has the right to adjust the prices annually, which will be done according to the market value and inflation.
  • GlobalFindr will communicate price adjustments to the user prior to their implementation.
  • The announcement of the price adjustment will be made public on the GlobalFindr’ app.

Article 3 – Payment term and subscription

  • We offer users to share limited content for free, if they want to upgrade to unlimited uploads, they can buy a subscription.
  • The yearly subscriptions are to be paid via the app immediately for a year or monthly in 12-payment settlements.
  • GlobalFindr only has two types of packages on the app, the free but limited (basic) package which includes a max upload of three flyers per month and a monthly/yearly subscription which includes unlimited flyer uploads.

Article 4 – Consequences of not paying on time

  • When the user does not pay on time, GlobalFindr will suspend its obligations until the user has fulfilled his payment obligation (example, failure to make use of the GlobalFindr Pro features).
  • If the user refuses to cooperate in the implementation of the agreement by GlobalFindr, he is still obliged to pay the agreed price to GlobalFindr.

Article 5 – Warranty and withdrawal

  • The parties have entered into an agreement with a service-providing nature, meaning this only contains an obligation of best efforts for GlobalFindr and therefore no obligation of result. Globalfindr will commit to create awareness, but is not responsible if the user does not achieve results.
  • All services are binding, therefore there is no right of withdrawal.

Article 6 – Execution of the agreement

  • GlobalFindr performs the agreement to the best of its knowledge and ability and in accordance with the requirements of good workmanship.
  • GlobalFindr has the right to have the agreed services (partially) performed by third parties.
  • Once the user has uploaded their content, only GlobalFindr has the right to review, share and to decide whether the content remains or be removed from the app. Therefore, the implementation of the agreement takes place after written agreement (the terms and conditions via the app) and payment of the agreed amount by the user.

Article 7 – Provision of information by the user

  • The user shall make all relevant information in regards to the event clearly visible on the content (this includes name of the organization, event name, date, time, location and possibly the price) and all other documents relevant to the correct execution of the agreement available to GlobalFindr in a timely manner and in the desired form and manner.
  • The user guarantees the correctness, completeness and reliability of the information, data and documents made available, even if these originate from third parties, in so far as the nature of the agreement does not dictate otherwise.
  • If the user does not make the information, data or documents reasonably required by GlobalFindr available, or does not do so in time or properly, and the execution of the agreement is delayed as a result, the resulting additional costs and extra hours will be borne by the user.

Article 8 – Duration of the agreement regarding a service

  • The agreement between GlobalFindr and the user regarding the event flyer promotion service is entered into for a definite period of time, which is one (1 year) unless the nature of the agreement dictates otherwise or the parties have expressly agreed otherwise in writing.
  • If the user has a one-time event flyer promoted, it will automatically terminate after the term has expired.

Article 9 – Cancel subscription

  • For IOS users: all monthly and yearly subscriptions can be canceled in Apple ID at least a day before your renewal date.
  • For ANDROID users: all monthly subscriptions are monthly cancellable after the first (3) months. All yearly subscriptions are monthly cancellable after (1) year. If you would like to unsubscribe, please contact us at our contact page to cancel your subscription via support@globalfindr.com.

Article 10 – Indemnity

The user indemnifies GlobalFindr against all third-party claims related to the services provided by GlobalFindr.

Article 11 – Complaints

  • The user must examine a service provided by GlobalFindr for possible shortcomings as soon as possible.
  • If a service provided does not meet what the user and/or consumer could reasonably expect from the agreement, the user must inform GlobalFindr of this as soon as possible, but in any case, within 1 week after the discovery of the shortcoming.
  • The user provides a description of the shortcoming that is as detailed as possible, so that GlobalFindr is able to respond adequately.
  • The user must demonstrate that the complaint relates to an agreement between the parties.
  • If a complaint relates to ongoing work, it can in any case not lead to GlobalFindr being forced to perform other work than has been agreed.

Article 12 – Notice of default

  • The user must notify GlobalFindr of any notice of default in writing.
  • It is the responsibility of the user that a notice of default actually reaches GlobalFindr (in time).

Article 13 – Joint and several liability of the user

If GlobalFindr enters into an agreement with multiple users, each of them will be jointly and severally liable for the full amounts due to GlobalFindr under that agreement.

Article 14 – Liability GlobalFindr

  • The agreement on GlobalFindr app is of a service-providing nature, therefore GlobalFindr is not liable for any damage suffered by the user.
  • All images, photos, videos, colors, drawings, descriptions on the app are only indicative and cannot give rise to compensation and/or dissolution of the agreement and/or suspension of any obligation.

Article 15 – Right to dissolution

  • The user has the right to dissolve the agreement if GlobalFindr imputably fails in the fulfillment of his obligations, unless this shortcoming does not justify termination due to its special nature or because it is of minor significance.
  • If the fulfillment of the obligation by GlobalFindr is not permanently or temporarily impossible, dissolution can only take place after GlobalFindr is in default.
  • GlobalFindr has the right to dissolve the agreement with the user if the user does not fully or timely fulfill its obligations under the agreement, or if GlobalFindr has become aware of circumstances that give it good grounds to fear that the user will not fulfill its obligations.

Article 16 – Change of general terms and conditions

  • GlobalFindr is entitled to change or supplement these general terms and conditions.
  • Changes of minor importance can be made at any time.
  • Major substantive changes will be discussed by GlobalFindr with the user in advance as much as possible.
  • Consumers are entitled to terminate the agreement in the event of a substantial change to the general terms and conditions.

Article 17 – Transfer of rights

  • User’s rights under an agreement between the parties cannot be transferred to third parties without the prior written consent of GlobalFindr.
  • This provision applies as a clause with proper legal effect as referred to in Section 3:83(2) of the Civil Code.

Article 18 – Consequences of nullity or voidability

  • If one or more provisions of these general terms and conditions prove to be void or voidable, this will not affect the other provisions of these terms and conditions.
  • In that case, a provision that is void or voidable will be replaced by a provision that comes closest to what GlobalFindr had in mind when drawing up the conditions on that point.

Article 19 – Applicable law and competent court

Dutch law applies exclusively to every agreement between the parties.
